Legal Question in Family Law in North Carolina

I am currently in agreement with my current husband that we need to go our seperate ways. I would like to seperate from him and find my own place considering we now live with my mother-in-law. I am the only one currently working and I am at poverty level. We have a 2 year old child and no valuables. I am desperate to leave. We live in North Carolina, could I move out without seeking legal advice. My husband and I have agreed upon joint custody and I would like to know if it would be considered abandonment if I were to leave with no legal advice. Please inform of my rights.
