Legal Question in Family Law in North Carolina

Custody

My husband had his girlfriend draw up a paper stating that we would have joint custody and there will be no primary physical custody and he wants me to sign it and have it notorized. My question is can there be no primary physical custody and will a notarized document stand up in court?

Re: Custody

You really need a proper parenting agreement or court order.

My advice is to have an attorney review the document that has been drafted.

Generally, primary custody is granted to one parent and secondary custody to the other. Also, the issue of decision making is critical because if the vote on issues such as which school will the child attend is 1 to 1; then you will be in Court anyway so the Judge can tell you what will happen.
