Legal Question in Family Law in North Carolina

divorce, custody/joint custody

we have been seperated for over 2 yrs. my 2 kids live with her, haven't been to court for cust. I want to try to get cust. or at least joint cust. I pay cs. She only lets me see them when she needs a baby sitter. Their is alcohol use around them, she doesn't keep a clean house, etc. she has two other kids and another one on the way.5 kids, 3 dads. she keeps getting preg. so she don't have to work. I understand I should help pay for them, but she made them just like i did, shouldn't she have t get a job and help support them to. She has moved on the lives with another man, but the dss doesn't know he lives there, so she gets help from dss to. I can barely afford t pay my bills for having to support all 6 of them until the baby is born then that will be 7. She said that is going to make sure that I don't spend any money on my new girlfriend. She i worried that she isn't going to get any money from me. Is their anythin that I can do? She lives in NC and I live in SC. Thanks!

You can certainly seek custody of the children, and it sounds as though you may have a good chance of getting them if you can prove all of the facts that you set forth above. However, it sounds as though the case will need to be filed in NC if she and the kids have been there all along.
