Legal Question in Family Law in North Carolina

My new husband wants to adopt my 3 year old son, his birt father has not seen him in 2 years and has no contact with him (he pays no child support). The birth father is not on his birth cert. but there has been dna testing that confirms he is the bio. father. Can I change my son's name on his birth cert. and put my husbands name on it with out the bio. dad's permission?
