I live in the state of NC and my former renter is threatening to take me to court for funds she feel she is owed. She is telling me that I will be responsible for her legal fees if this happens. Is this threat accurate?

In North Carolina, each party pays their own legal fees in most cases. Because you are a landlord and this is a former tenant, if they are bringing action for the return of a security deposit that you may have keep, then legal fees may be at issue. The security deposit law in NC, requires the landlord to return the security deposit within 30 days and/or an explaination of how some or all of the money was used for damages.

If the landlord wrongfully refuses to return the security deposit, the former tenant can sue and get attorney fees as well.
