Legal Question in Employment Law in North Carolina

I am an independent contractor delivery driver. Under new ownership the restraunt I work at has stopped paying me any kind of hourly rate. I only receive tips and commission. Can they legally do this?

Unfortunately yes. As an employee there are limited rights to guaranteed payment. As an independent contract, you have even less rights unfortunately. You only have a cause of action to prevent this if you have a contract that had not yet expired and they breached it.
