Legal Question in Personal Injury in North Carolina

injureed at work

I was injured at work (cntract labor). Multiple bulging discs. I was in severe pain for about a 9 months Still experience pain if I'm not careful. How do I figure pain and suffering and future medical in this liability settlement?

Re: injureed at work

There are multiple issues here, and you may need to consult with an attorney in your area with more information for more specific guidance. You may have a workers compensation claim, which allows you to receive medical treatment, a portion of your lost earnings, and further compensation if you have any permanent impairment. If you have ongoing problems, then you may have ongoing work limitations, and your claim for lost earnings may therefore be ongoing. Computing your earnings claim and your disability claim are very difficult, and you probably need to consult with an attorney to discuss the value for those. It is not clear whether you have a claim against someone else (i.e. not your employer); if so, then you have additional rights to recovery (e.g. pain and suffering), and evaluating this type of claim is very difficult; in fact, if the symptoms are ongoing, and have not reached maximum improvement, it may be premature to value the claim. You again probably want to consult with an attorney in your area to get more information about this.
