Legal Question in Real Estate Law in North Carolina

landlord/tenant

I rent a home in NC. My landlord is in foreclosure on the home, has not made a payment on this home since I have llived here, Oct. '08. I have made my rent payments on time every monthl I understnd he is the 'owner' until 07/16/09.

Should I pay my rent for this month? The home is to go on auction 08/06/09. When will I have to move out?

Re: landlord/tenant

I didn't read the following law yet but you may want to look into it. I just read about it in a newsletter which said the following.

"Congress has passed and the President has signed into law, the "Protecting Tenants

at Foreclosure Act of 2009",

effective May 20, 2009 (Public Law 111-22). This Act provides that with respect to

residential rental properties foreclosed

on or after May 20, 2009, that any immediate successor in interest to residential

property in foreclosure assumes such interest subject to:

(1) giving an existing tenant at least 90-day notice to vacate; and (2) specified

rights of such tenant to occupy the premises until the end of the lease. "
