Unauthorized Signing of a Lease

I own property in NC that is located on a major interstate

highway. The property owner adjoining my property signed a

lease with a major advertising

company and has received several thousands of dollars for a billboard that is on my property. He has agreed to turn the lease over to me, but he refuses to reimburse for monies collected. What are my legal options?

There may be a theory under which you can sue your neighbor, but it is not clear. He did not take, use, or convert your property directly, but he essentially aided and abetted and encouraged another party to do so. Your clearest claim is against the advertising company. They were technically trespassing on your land. They would probably have a claim against your neighbor for breaching a warranty in connection with the lease. You may want to consult an attorney.
