divorce and auto registration

Our car was titled in both our names, but in our divorce I signed over the title to my exwife. She is currently driving on expired NC tags in the state of VA, and has not registered the car solely in her name. I dropped the insurance on the car whenI turned it over to her. Am I liable if she is involved in an accident. We were divorced in the state of VA.

Your question involves both NC and VA legal issues because you say she is driving in VA.

In Virginia, it is against the law to own or have a car registered without insurance. So if the DMV is not aware that you are no longer an owner, and there is no insurance, that could be a problem.

You would not be responsible for her getting in an accident. The driver is responsible for any accidents, not the owner of the car.

But owning a car and not getting insurance on it is a problem for you.

SInce you have probably given the title signed over to her TO HER already, this may be difficult. You should see if there is some way to tell the DMV in either NC or VA that you don't own the car, but she has not gotten around to filing the title signed over yet. I don't know if there is some form for that or some way to to do that.
