Legal Question in Workers Comp in North Carolina

I have returned to work now what?

I fell and cracked my hip back in August 2006. I have since got legal council. I still keep being pushed by my emp and workers comp co to do more than restrictions allow and my emp seems to be trying to find me doing something wrong. I get TD still and I want to know should I leave my job and get somthing else? Do wokers comp and empy try and get you to quit? Do they work together to make things as hard on you as possible? Is it normal to by so depressed and feel like you are not wanted and work? Like you are under a microscope? I just need someone that has experence to tell me what they did.I really feel like just saying dear god just end it. I give up. This has torn my family apart and I cant go on much longer feeling this way.

Re: I have returned to work now what?

Consult with your atty regarding what you should do about your job, but I would not put myself in a position where employer could say you quit and they had work you could do within your restrictions.

You are in the midst of a system that is frustrating to all claimant's on a good day. You need to resolve to be more patient than they are, as they know they can get a better (ie., cheaper) settlement from a claimant that is stressed and "just wants out of the system".

Perhaps you are depressed due to your injury/disability and need professional treatment. Get a referral, by name, for mental health evaluation from your authorized treating doctor. Then, WC needs to start setting it up with the dr you were referred to and paying for it.

Good luck!
