Purchase agreement contract

We were in the process of buying a home through someone without a realtor. We paid the guy our earnest money and signed the purchase agreement. The bank did the appraisal and it didn't appraise for what he was asking. We told him this and he said he would think about what he was going to do. He never called us back, never returned our calls and he still has our earnest money. Well today I find out that he listed the house with a realtor. How can he do this when we have a signed purchase agreement from him and he never told us that our agreement was void or that he was out?

This question can only be answered after a lawyer examines the contracts signed. Usually, there are clauses that protect the money in this event but a lawyer needs to review the documents.
