Legal Question in Bankruptcy in Ohio

bankruptcy

In short I would like to find out if I am responsible for an amount of tax refund that my wife spent that was to be paid in to the bankruptcy court. We have been separated and living apart for over 1 year . She had filed her own tax and claimed both children w/out my knowing. The case was over about a year ago but we just got a paper that said we owe a certain amount (I do not even know the amt. of tax refund she received but I believe that she did not pay this back, I think it was about 2400.00). We had both signed the divorce papers but she did not finish them, she wanted the divorce ,she was seeing someone else, she said she did not have the money to finish . If separation means that she is on her own ,I should not be responsible , this is what she wanted. And if I am responsible for this this amt.should this be split from each of our pay checks? I have until the end of august to reply. Thank You

Re: bankruptcy

Was the divorce finally granted? Were you still married when the bankruptcy was filed? If you are found to owe the entire amount to the trustee, you would have a case against her for half of what is owed.
