Legal Question in Civil Rights Law in Ohio

IN 2005 I filed for a divorce In Akron Ohio. I recently found out for the past Five years that the courts are handing out my divorce papers as an Example for the public to view if someone is filing for a divorce without an attorney. The information that the courts are sharing is my five year old daughters name and birth-date. It is a complete copy of my divorce papers. So I filed a small claim against the head of the courts and now they are trying to use orc 2744.02 . stating that they are immured. Where my daughters civil rights violated?

Your divorce "papers" is a matter of public record. If you put your daughter's name and age in the papers it is there for anyone to see. The ORC 2744 immunity statute is not really relevant but could be used as a defense. Further, what damages are you claiming? Was your daughter harmed in some way? Was it right to publish this without redacting (deleting) your daughter's information--no. But was it a violation of civil rights--I doubt it.

This is another example of not getting a qualified person (lawyer) to do the job. It ends up costing you much more in the end. Please, hire an attorney to write a letter to the Clerk of Courts. Perhaps an attorney can persuade the Clerk to delete the objectionable information.
