Legal Question in Construction Law in Ohio

Built House (not done), Builder Going Bankrupt

Hi. I am looking for some help. We built a home and moved in January. There were some items not done (A/C, trim painting, grading, etc) due to weather. The builder is now going bankrupt, and says they can't take care of our outstanding items because the bank has their finances. We already paid for these items that were in our contract when we closed on the house. What action can we take, if any, to at least get some of the money back so we can take care of these items on our own now? We spent most of our savings on the house downpayment, and now don't have much left to do these things. The builder already has a new company started under a different name, but seems unwilling to take care of our items with money from that new company. Please help.

Dear Inquirers: Much will depend upon your contract with the builder. You may have an action against him personally, for fraud, etc., however, you'll need the advice (and expense) of an experienced attorney to guide and advise you and file the necessary actions.
