Legal Question in Criminal Law in Ohio

my brother went to a house party, 10 minutes after being there the cops showed up and he was charged with fourth degree criminal trespassing. he has a clean record. what could his punishment be

he did not know that he had done anything wrong. him and a buddy were invited to the party.

what should he plead when he goes to court on monday. he is to graduate college this month and with the field that he has studied something like this on his record could ruin him before he even gets started

In ohio if he was invited to the party and had not been told to leave then this is a defense to trespassing. Unless the prosecutor has a witness to say differently it's going to be very difficult to convict for trespassing. Heshould plead not guilty and speak with the prosecutor at the pre trial through a lawyer if possible about his having been invited to the party.
