Legal Question in Criminal Law in Ohio

a cop pulled me over and said someone called the dispatcher and said i was rolling a joint. which was untrue. he searched my car and found a marijuana pipe. this is my first offense. im 19 years old. what will be the results of this? i have a court date. how much will the fine be? will i have to serve community service? will i be put on probabation?

If you violated just "Illegal use or possession of drug paraphernalia", Ohio Revised Code section 2925.14(C)(1), you would be guilty of a misdemeanor 4 which is the second lowest misdemeanor (selling to juveniles, advertising or dealing in paraphenalia are higher misdemeanors.) An M4 could result in $250 fine plus court costs and up to 30 days in jail. However, I would be stunned if you got any time for this offense. More likely, some community service and some unreportable probation. (Unreportable probation is when the judge sentences you to some period whereby you do not get into any more trouble or you can be sentenced again to a greater punishment. But you do not need to check-in regularly with a probation officer.

Then, one year after your probation ends, you can petition the court to expunge your record as long as this is a first offense and you don't subsequently get convicted for another crime.
