Legal Question in Criminal Law in Ohio

Husband and Wife City Ordinance

I was charged with violating a city ordinance dealing with a gravel driveway. I was found guilty and paid fines and court cost. The city charged my wife seperate, she has an upcoming court date. The city said they will waive her cae for court costs. Is this legal? Charging two people with the same offense?

Re: Husband and Wife City Ordinance

I would not expect the City to pursue charges against both people if the first case resolved the problem. Without reading the actual ordinance involved, it is impossible to say whether it is legal to charge and convict both of you.

Depending on the fine and costs involved, you may want to see an attorney to defend your wife on this case.
