Legal Question in Family Law in Ohio

My husband or 20 years is a HOPELESS alcoholic. We have a 15 year old son who will not leave willingly with me to the local domestic violence shelter. I don't want to drag him kicking and screaming out the door..It would seem that he has more rights than I do. Who could possibly help me? What do I do? What kind of attorney do I contact? We can not stay in this household! Please help.

If there has been a recent incident of domestic violence you can call the police and tell them what happened and your husband will be arrested. Generally, the prosecutor will then insist upon a stay away order and your husband will have to vacate the home.

If you file for divorce, you can seek temporary custody of the children during the pendency of the case, as well as exclusive use of the marital home during the pendency of the case.

If you cannot afford a lawyer, there may be a legal clinic at a local law school which may help you, or you can phone legal aid if there is one in your area. You can also call your local county or city bar association as they may be able to refer you to a lawyer who can assist you.
