Illegal Immigration form I-130

I'm married to an illegal alien. Can I apply for him to stay using form I-130? Will he have to go back to Mexico to do this?

It depends on how your husband entered the U.S. and if he entered without inspection, when he did. You may have to go back to Mexico, but not necessarily. Contact an immigration attorney to discuss your case.

That would depend on how your spouse entered the U.S. and any criminal record or prior immigration issues. You can use the I-130 to Petition but you should really consult a lawyer first to discuss the issues mentioned above.
