life insurance for burial

my wife's uncle died yesterday. his life insurance policy (ohio) names his much younger missing wife (disappeared when they put him in nursing home three years ago and current location unknown) is named as beneficiary. under ohio law, is there any way the family can use that policy to bury the man without the missing wife's consent, and designate the remaining cash back to the insurance company for her if she is ever found.

A Court action will probably have to be instituted to determine the disposition of the funds unless the policy itself speaks to that situation.

The answer to your question is "no." Sorry. What you want to do with the money is admirable, but I can't imagine a life insurance company releasing the money, absent some special provision in the policy for burial expenses. Check the policy for a separate burial benefit.
