drug test for work

If a person has an incident at work and is sent for a drug test but on the way there he/ she gets in an accident, can they hold the person who sent them responsible? (The person would probably be off the clock at the time of accident)

Vicarious liability is a possibility. It would require extensive research to discern the grey area.
