use of va/sick days concurrent with fmla

the company contends they have the right to unilaterally require employees to use vac/sick days when on fmla. are their arbitrations that rebuke this? do they have to negotiate this or can they impose without bargaining?

Unless the employer is bound by contrary terms contained in a collective bargaining agreement, then yes, the employer can change its policies and the policy you reference does not violate the FMLA.
