Legal Question in Medical Malpractice in Ohio

last year I had a total hysterectomy in June, I went home in a few days, and did not feel well, for the next two weeks, i kept going to the doctor complaining of pain and he said everything was okay, finally my husband took me to the emergency room, and it was hell in there, they found out that I had an infection, so I had to stay another week, and I had to have a small surgery to correct the problem, well I still hurt at times, and it has changed my life in so many ways. I did go through pain and suffering and still going. What do you think?

First of all you have a one year statute of limitations which will run on the one year anniversary of your surgery. There are ways to extend it but you will need to contact a malpractice attorney immediately. It is impossible to determine whether you have a case without reviewing the records from your surgery. Often times it is impossible to prove a doctor was negligent just because you got an infection, however there may be other facts (not prescribing pre-op antibiotics) which may be worth exploring.
