Very Large Dead Tree

My neighbor has a very large dead tree in her yard. The tree hangs over into my yard. Bracnches and limbs have damaged our gargage. We have grandchildren and a dog we are afraid to let play in the yard. We cannot have anything repaired, because the limbs continue to fall. I have spoken with her husband and last week I sent them a certified letter regarding the tree. She came to our home and very angarily informed us, her attroney and her insurance company told her she was not liable and to leave her alone. She stated she was not paying for any damages or removing the last of 3 incidents of debris that has fallen in our yard. My husband has cleaned up, cut up and hauled limbs and branches on three diffirent occasions. We are not able to enjoy our backyard

Under Ohio Law if her tree is interfering with your right to enjoy your property and causing damage, she is liable so long as she is put on notice of the tree's dead condition. There may be some additional issues but that is the general state of the law in Ohio. Feel free to contact me to discuss this further.
