Crosswalk Laws

My son was struck by a car while he was jogging across the crosswalk on the red light after school. We live in a very small town and the person who hit him is from a well named family here. The village police dept. said she was at fault but refused to site her, when I insisted on the reason, they said because my son violated traffic laws by jogging across the crosswalk. And if I persued it they would in turn site him as well. I looked up the law they were referring to and feel it is meant when someone purposly walks or runs out in front of an oncoming car and causes an accident then he is violating the law. My son had the right of way with the light and she was making a left hand turn onto the side of the road he was in. Can you please tell me if he was in the wrong. Or am I dealing with small town politics.

This is a close case. I can see both sides. Did your son stop before he

crossed? at what point did the light change Were there any witnesses? Was he

injured? Often, where both sides have arguably violated a traffic ordinance,

the police will charge neither, and let them fight it out in civil court. If
