Buying out a family member

My brother, his daughter and I have inherited my father's home. I wish to buy out my brother's share.

I am the executor. I was advised to have him sign a quitclaim deed for fair value before I probate the will. Is the fair value the value of the home minus the second mortgage divide into 3 parts and what if he refuses to sell?

Whose name is the house in. If the house is in your fathers name you can not transfer the house without the approval of the probate Court
