Legal Question in Wills and Trusts in Ohio

Filing with probate court

My mother just died and her and my father owned only a house and car and they were in both names and she left them to my dad her husband in her will they were still married and living together at thje time of death and i am wondering if we need to file anything in probate court or if we are fine just paying off her bills as we had been and just leaving everything the way it is if we need to have her named removed both item still have leins on them?

A probate filing is not going to affect any liens on the properties. You are going to have to file survivorship affidavits on the properties, and also file an estate tax return for the state of Ohio.

First, in order to transfer the vehicle, you need to take the title and a death certificate to the title office and they will transfer it to your father. Second as far as the house is concerned, it depends on how it is owned. Eventually, you will need to take Mom's name off of the title in order to eventually transfer the property.
