Power of Attorney

My father is being put in nursing home. He is no longer competent. How can my mother get Power of Attorney? My father has no will, and now my mother is faced with financial and legal decisions without power of attorney! What can be done?

If your father is incompentent, you will not be able to get a power of attorney from him nor will he be able to create a will. However, your mother can file for guardianship through the probate court in the county that they reside. She can apply for guardianship of his person &/or estate. Once she is appointed she will be able to make these decisions for him.
