My step-daughters bio mother died a few months ago. They did not have a close relationship & my daughter has no relationship with that side of the family either. So last month, I filed SS benefits, in which I was told that we are owed survivorship, death, & a 1 time death benefit amount. Apparently, her bio mother never included my daughter when she filed for disability, so we are to receive that back amount! Today, I received her last will & testament in the mail which says that all SS benefits are to be handled by her father (my daughters maternal grandfather) & deposited in a trust fund until my daughter turns 18. This does not make sense to us for several reasons & now we want to make sure that we receive those SS funds that are owed to my daughter ASAP. Once again, my daughter has no relations with that side & we certainly don't feel that these funds should be handled that way. We have had custody of this child for 7 years & feel that my husband (bio father) should have all rights to how those funds are allocated. To my knowledge, our application has been processed & will be receiving funds soon; we just want to make sure this will happen. Please send your comments.
