Legal Question in Bankruptcy in Oklahoma

workers comp

my husband got hurt really badly at work. we are having to file banruptcy. we have tons of debt we cant get out of the lawyers are suing his work for negligence and probably will win but it may take up to a year if not longer.. right now banruptcy is the only answer.. can they take all our settlement money in the future if we file now. betwen us we are now with the house at lest 500,000 in debt.. please help. we are going to have to get a banruptcy attny but cant afford to get one for another month or so and i am unemployed .. they are forclosing on out house .i just need to know if we should wait till the court goes to trial or we should do it now thank you--name removed--richards

If your house is in foreclosure and you are interested in keeping it, I would immediately seek bankruptcy protection. If you cannot now afford an attorney, you can either file the petition pro se or contact your local legal aid office for help. Just be sure and list your claim in the bankruptcy or your right to proceed may be lost forever.
