Legal Question in Civil Rights Law in Oklahoma

assault & battery, mistermenor

I was given a fine to pay and 6 mo. probation. They called it a defered sentence at the time I was signing the paperwork and after paying my fine and stayed out of trouble during my probation period then the records would not show my conviction anymore. Now they tell me thats not gonna happen and that the charges and conviction will be on my record forever. Since the incident I have married and had a child and I have to go back to work. NO ONE will hire me now because of my record. Lowes acually was very exited to hire me because I have so many skills, management, etc. but within a week they got my court record and seen that charge and wouldn't even give me the courtesy of calling me to tell me why I was not hiring material until I called them to see why I hadn't heard from them! I was told from a friend that I would need to hire an attorney and have the conviction ''exponged'' (i don't know if i spelled that right). I have no money and feel so worthless because of all this. Can someone out there please help me. I don't even know how I got the charges to start with, I never touched anyone, my sister was the one having the issue, I was just there and the plantiffs told lies and the judge believed them so I got convicted.

Re: assault & battery, mistermenor

The fact that you admitted guilt, you were held accountable for the conviction. This is a common problem with plea bargaining.

Secondly, you will need an attorney to handle the matter or reopen your case to determine the facts before any action or responses can be provided.

In the meantime, please learn from this mistake. Even if it's difficult or inconvenient for you...never, never plea guilty to ANYTHING if you are NOT guilty, no matter what you are told by others. Allow the burden of proof to remain with the courts making the accusations.
