the neighbor next to me has dogs that keep coming on my property and digging holes and using my yard as a bathroom,he has one chained but they get out.

Give him written notice to put up a fence or put his dogs up. Then file in small claims and ask the court for money damages, ie cost of a fence.

After you have provided written notice of you intent to file suit if the owners of dogs do not restrain the dogs you also have the option of notifying the city pound and reporting the neighbor's failure to restrain them. This report can also be used in small claims court when seeking recovery of damages to your property.
