Legal Question in Civil Litigation in Oklahoma

My wife and I purchased a lot and built a home 2 1/2 years ago. We were sold the lot and the home with the understanding that our home would be the last home on the street. We were told that a bridge would be built across the 2 ponds that our home sides up to now. Recently we were told that a mistake had been made in the original layout of the housing addition and the road that runs in front of our home was in the wrong place. We were told that the cost to build the bridge now would be too great. The company sold the land and said they would not be building in that section. Consequently, our home is now located where the street ends at the 2 ponds and has become a parking lot for all the people that come to the ponds for a variety of activities. Its always noisey and people continually use our driveway.If we had known that they were not going to build across the ponds and complete our street we would have never bought there. Do we have any options ?

Yes, look at your contract with the developer/contractor. If contract provides that the company would build a bridge, then you have the right to bring a breach of contract action against the original developer/contractor who sold you the property.

You need to find out if the current developer took over allthe duties and liabilites of the original developer? If so, you should bring the new developer into your action.

Check with your neighbors and see if they have had similar problems. If so, you could file a group action.

As regards people parking on your driveway, just put up a sign that they cannot park there. Notify the police next time they do.
