Legal Question in Employment Law in Oklahoma

My husband was let go from a job last year because of a school district policy that states employed spouses may not work in the same building together where close daily contact may be an issue. The position he was in was changed by the school district because of the opening of a new school building which I was set to work in. This policy has been in place since the early 90's, but several people have been exempted from this rule -- several cases include spouses that met and married after both were already in positions at the same school. My husband was considered a temporary employee because he was in his first year after a leave of absence but all 9 of his years experience have been with this same school district. They did not even offer him an opportunity for transfer, they just released him from his contract. This summer a couple got married that worked at the same school. They were told they could not work together but they fought the policy and were allowed to work together despite the fact that they made the decision to marry (because of all the other married couples still working together). Do we at all have a case? His former principal informed him that the only reason he was not allowed to return was because the position would require we work in the same building part time (only 2 1/2 days per week). I only saw his replacement maybe a few times the entire year which I do not believe constitutes close daily contact. My husband has been without work all this past year and looks to be out of work again this year because the market for teachers is so tight right now. Please help... Thank you!
