Legal Question in Real Estate Law in Oklahoma

Legal Ownership

My fiance and I bought a home six years ago for $115,000 and there is $58,000 left on the loan. He is on the mortgage loan, but we are both on the title of the home. He wants to resolve the relationship and give me $10,000 for my part. Even though I have not made any payments, am I entitled to half of the house.

Thank you,

Re: Legal Ownership

A definite yes or no cannot be given based upon the brief set of facts you presented. You need to schedule an appointment with an experienced attorney who will ask you the proper questions to determine you rights. Most attorneys will confer with you on a free consultation and explain your legal and equitable positions relative to your potential interest in the property in detail that cannot be covered here. Even then, no attorney can guarantee to you the outcome of litigation, if it goes that far. Be wary of any attorney who says that your rights are clear cut. Equity may enter the picture to do that which ought to be done.
