child rights when their is a deceased parent

my 11 and 13 year old daughters father recently died and his father has taken over every part of his property/money. are the girl entitled to his estate as opposed to his father?

If the decedent was not married and did not have a will at the time of his death, then his children are entitled to receive his estate. You may need to file a probate action to ensure that the estate is properly accounted for and distributed.
