When using an agreement for marketing is it legal to bind the heirs to honor the use of the marketing strategy?

A contract can be made binding on heirs, if the heirs inherit the benefits of the contract. I do not know what you mean by "an agreement for marketing," so it may nor may not be appropriate or enforceable.
