I have a 5 year old her father anc myself are in the process of court hearing there is no legal document prior for our daughter am I still able take my daughter to visit another state without permission?

YES, in the absence of a court order that says otherwise, you may take your daughter to visit another state without permission (at least under Oregon law, which may differ from other states).
