Legal Question in Family Law in Oregon

do i need to re file my divorce?

in may 2001 I filed for divorce, i attended the parenting classes and had my meeting with the judge. all I needed to do was pay the fees. in feb.2002 my husband and I reconciled, I wrote a letter to the judge and told him I would not be seeking the divorce. The fees were taken from my state income tax return. now in july 2003, my husband and i are really ready to divorce. do i have to refile all the paperwork, can i go back to the original filing, do i have to pay the fees again?

Probably but maybe the court will entertain a motion to reopen the old case - attach your affidavit to the motion setting forth your reasons and why it is such a hardship, etc. Even if the case is reopened, you'll have to make current all of the old information.
