Legal Question in Family Law in Oregon

My husband was my high school teacher....He followed me to college and I married him when I was done with college; we now have a child. I want a divorce, but I know that once I serve him with papers he will make life miserable for me and my son. I would like to move out first (a day-move, taking what we can bring in my car) and then file for divorce so we (my son and I) don't get the backlash of his anger. Are there laws or orders I can use so that I can do this legally?

ANSWER:

Until and unless there is a court order saying otherwise (which would not happen until and unless a divorce case had been filed and was pending), you are free to pack-up yourself, your son, and your belongings and move to wherever you want to go. There are no Oregon laws placing any restraints, restrictions or limitations on your ability to make the move. After you make the move, you can then file for divorce.
