Legal Question in Appeals and Writs in Pakistan
if an accused nominated in the FIR,is not challaned by the police,nor got him discharged from the magistrate nor kept him in column No:2, how that accused be summoned in the special court where the trial for other accused are in progress?

police findings are not binding upon the court,if the trial court deems it necessary ,it may summon the so called co accused whom the police considers as innocent and vice versa.
