Legal Question in Civil Rights Law in Pennsylvania

Suit against Sears

For the past five weeks I have been having prolems with Sears service and the scheduling and repairing of my washing machine. I have been unable to speak to anyone in authority and have been given the run around. I have spent endless hours waiting for techs to arrive, only to be rescheduled or then not having the right parts. I have had to cut short vacation time to return home for the repairs, only to have nothing completed. Again this has been 5 weeks. What can I do legally? I have been inconvenienced and had precious time lost due to Sears incompetence and inabliltiy to provide the service. I have a service contract and do not want to spend additional money to repair the washer. Is there anything I can do legally? Is there anyone who can help me with this issue? I am frustrated, but determined. Thank you for your help.

Re: Suit against Sears

You need to read the terms of your warranty contract with Sears and be sure you have abided by the terms. Then if you have and you are still not satisfied with whatever Sears has done, you should most likely be able to sue in Small Claims Court to recover the money you have expended to have it repaired elsewhere. You might be able to sue for more than the repairs - any out-of-pocket costs you have expended may be recoverable.

If you want me to send you a brochure about how to pursue claims in Small Claims Court, send me an e-mail and your street address and I will send you the brochure.

Good luck!
