Employer monitoring email

I currently have an employer who reads employee email. According to the company's Email usage policy, there is no mention of manangement reserving the right to monitor email. Also, there is no electronic usage agreement that was to be signed by the employees. If management uses employee email against its workers, do the workers have grounds for a grievance?
