Legal Question in Technology Law in Pennsylvania

Internet Setup Issues

My business was requested to do a reinstall of computer operating system software and drivers. We warrant this service for 15 day. Anything past this portion of the reinstall is only as a customer request and is not warranted. We were asked to install this customers Internet Service Provider Information. We were given partial information. The customer did not tell us of restriction on his phone service so we installed his information with phone numbers for our local area. With the exception of his small area, these phone numbers are not long distance. The phone number in question is long distance to his area alone. The customer now requests that we pay for their two months of long distance service due to the fact that we installed the incorrect phone number. It is outlined in our warranty that charges from use or no use of the computer, including phone, power and any other charges are the responsibility of the customer. Are we liable for these charges? Even if it was the customer who initiated each and every call placed with their computer? And even if its clearly outlined that this portion of the install is the sole responsibility of the consumer?

YOur client must abide by the terms of your warranty. However, this doe not mean that they won't sue you. They will have to prove there case like anyone else.

Re: Internet Setup Issues

Sounds as if they have an uphill battle chasing you on this one. Suggest that you stand pat and fight it out in small claims court if they actually pursue the matter further.
