Legal Question in Constitutional Law in Pennsylvania

held in jail for 5 days with no information

my son was recently arrested for 'failure to appear'' the offense was apparently a couple of years ago and he does not recall what it is about....he happened to be about 5 hours away from home, in our home state of pennsylvania but not in our county, He has been in the county jail since last wednesday and today is sunday. He has not seen a judge nor has he been given any information on the charge. Is there anything we can do to help him? is it legal to hold him for 5 days with no information?

Re: held in jail for 5 days with no information

Assuming the failure to appear occurred in your home county you need to contact the district attorney. If its the week they're holding criminal trials don't expect a quick return call. You can also call the clerk of the court in the county the incident happened and they should be able to give you the details as to what charges for which he failed to appear.

They are most likely holding him till he can be transferred back to the county where the warrant for his arrest was issued.

If you have any questions feel free to contact me. The initial consultation is free.
