Legal Question in Construction Law in Pennsylvania

Moved into a new home 10/2002 over the past 7+ years we have had leaks from the roof. Builder tried to fix the leaks several times to no avail. Last year we had at least 50+ shingles blow off the roof causing leaks (ceilings, rug and walls in 6 rooms)

Builder has blown us away telling us it was our responsibility to keep upkeep. I have owned 5 homes and this is the first with roof problems.

We decided to use our insurance, long story short, they claim bad workmanship and inferior shingles.We do have the name of shingle manufacturer. Insurance company will not compensate for a new roof and builder walked away.

Sorry, but you will need to get all your paperwork together, and sit down with an attorney. There is a 6 year contract statue of limitations (SOL) in PA, but if repair work was done, you may be able to assert the 6 yr SOL from the date of repairs. There are too many factors to address in an e-mail, so you need a consult, and for that to be effective, you need to prepare first, and get all your papers together. You may not be entitled to file suit, you may need to go to arbitration, which is just ONE of about 30-40 questions you need to answer before anyone can give you an informed answer. Most attys will give a 30 min. consult w/o charge, but yours will not be a 30 minute consult, so be prepared to pay some fee for a comprehensive consult. There is also a good chance, the atty will need to s/w you, then review your paperwork, then meet with you again. Sorry, but if you want answers, that is what may be involved. Good luck!
