Legal Question in Consumer Law in Pennsylvania

My husband and i just purchased a used 2003 nissan altima 3/3/11. On 3/8/11 he was coming back from the store and the engine started making terrible noise and the oil light came on.. He checked the oil and there was none on the dipstick. He had checked the oil the day we got the car and it was full.. We contacted the dealer we got it from to let them know the owner wasn't there so the mechanic checked the car out and said there was no leaks..We also contacted the warranty holder which is carsprotectionplus.com.. Later that day he took the car to a toyota dealer to have them check it out.. They said there is something internally wrong with the engine..It's went thru a gallon and a 1/2 of oil since then..Now the car came with a 3 month/ 4,500 mile warranty. So we finally got ahold of the dealer today. He said we should of never contacted the c.a.r.s warranty and we shouldn't of took the car to be checked out by anyone else.. He said the toyota dealer lied to us that there is nothing wrong with the car. He wants us to go to his mechanic.. Why? so they can slap junkyard parts on it .. Our warranty says we can go to any licensed repair shop in the united states.. People are saying we can get our money back in the first 30 days? Basically the dealer told me not to call back and hung up. Any advice would be good

Andrew Solomon Law Office of Andrew A. Solomon

You should immediately go to the nearest District Justice Court and file a Civil Action against the dealer who sold you the car. Further, you should consult an attorney in your area IMMEDIATELY, and bring with you all of the papers you have. Take these actions immediately. Under the Pa Consumer Protection Act, and depending on the documents you have, you may be able to have the dealer pay your legal fees and collect additional dmages above and beyond the cost of the car. For additional information, you should Google: PA Consumer Protection Act, which should supply you with additional information. Good luck.
