Legal Question in Credit and Debt Law in Pennsylvania

Can an attorneys office sue you for money owed to a credit card company,that was sold to a collection company? they filed a complaint in my county court,which is Monroe County in the state of Pa.The credit card company has it listed as a charge off.They call me at least 10 times a day.

This question really does not make sense. Attorneys represent clients and of course they can sue on behalf of those clients. The law firm is suing here on behalf of the junk debt buyer collection company.

Charge off is just an accounting term. It means that the credit card company has given up trying to collect the debt. It does not mean that the debt goes away or that you no longer owe the debt.

I do not know when you were sued. PA gives a very short time to object to or answer the complaint (20) days. I also do not know who the law firm is who is suing you although I could hazard a few educated guesses. It may be that you have good grounds to object.

I would immediately take the complaint to a lawyer specializing in credit card defense. There are many in PA although your best luck will be in Pittsburgh or Philadephia. I know that neither is in Monroe County but many lawyers do a statewide practice in this area.

The short answer is yes, however a good credit card defense attorney may be able to make it go away. Trying to defend it yourself will almost guarantee that it will not go away in Pennsylvania.
