Criminal theft

While waiting to be evicted in several days from an apartment in his name as leasee, my son was picked up and is being held by legal authorities on a matter that may have occured 4 years ago. His live-in girlfriend (listed as an 'occupant' on the lease) proceeded to have her father and uncle remove all my son's major ''stuff'' (bedroom set, big screen TV, etc. - for which I have receiptes in HIS name.) I had a police report taken WHILE they were loading up stuff (all names, addresses, license plate numbers, etc.) and the apartement manager filled out a police report the next day saying she had alrelady adivsed the girlfriend that she had no legal right to any property that was not obviously her own since she was not a ''leasee''. The police now say this is a civil matter. Now that I have power-of attorney for my son, I want them to issue an arrest for criminal theft. How do I get the police to do this, usindg their own report as the basis? If arrest warrants are issued I'm sure my son's stuff will be returned. I don't want charges pressed, I just really want the stuff back.

I recommend calling the District Attorney's office directly and pleading your case. If the DA won't prosecute, go down to your local courthouse and file a private criminal complaint. Your third option is to file a lawsuit in small claims court. This is something you can do yourself at a relatively low cost. Good luck to you.
